Terms and Conditions for Canada
This document contains important information about your purchase. By placing an order on this site, you indicate that you have read and agree to the terms and conditions as stated herein.

Prices
Prices are set at the sole discretion of Oki Data and are subject to change without notice. Prices in this part of Oki Data's web site are in Canadian dollars (CDN) unless otherwise stated. Additional charges for appropriate taxes, shipping and/or handling costs may also apply and will be added to purchase at time of order. Please note that initially-stated tax amounts are estimates only. The actual tax amount is only final once you receive your order confirmation, at the same time as your order number (either online or via email).

Payment
Payment may be made by valid VISA, MasterCard or American Express credit card only. Oki Data will ship orders after receipt of credit card approval. Oki Data reserves the right of refusal of the order for credit cards when sufficient funds are unavailable. At this time, Oki Data is unable to accept tax exempt orders/requests via www.okidata.com. Tax exempt customers must contact our customer support department (at 1-800-OKIDATA) to make special arrangements prior to purchasing. Proof of tax-exempt status will be required.

Order Placement
Oki Data will make every reasonable attempt to accept orders placed at www.okidata.com 24 hours a day, 7 days a week. Oki Data will accept orders only for goods available in its physical inventory at time of order, as well as for backordered items. Notice will be given at time of order, if any item is currently out of stock and on backorder. You will be given the choice as to whether or not you wish to place the order/backorder. This portion of Oki Data's web site only accepts orders with Canadian delivery addresses. U.S. orders my be placed in the U.S. portion of the web site.

Shipping
Oki Data will make every reasonable attempt to process and ship orders from Oki Data's facilities within two business days (day of order, plus one day), if orders are placed before 3:00 p.m. (EST/EDT). Orders received after that time will be considered the next business day and shipped according to the aforementioned terms. At this time, there is no option for Saturday or Sunday delivery. Oki Data is committed to doing its best to process and ship all orders as expeditiously as possible.

All orders will automatically be covered by standard insurance based on a value of $100 (CDN), and will be shipped via one of two possible service options (Express or Ground). Oki Data reserves the right to select carriers and provide the service options available for delivery. All orders will be charged applicable shipping and/or handling fees, based on weight.

Order Cancellation
At final order placement, you will have the opportunity to review all charges applicable to your order, including product prices, subtotal, tax, and shipping/handling. You will also receive a confirmation of your order either online, via e-mail or both. Once the order is accepted by www.okidata.com, it can not be canceled before you receive the goods. Upon receipt, you will need to contact Oki Data's Customer Support department for any issues relating to returns. Please refer to Returns section below.

Customer Support
For customer support, you may call our customer support department at 1-800-OKIDATA (654-3282). This service is available 24 hours a day, 7 days a week. Additional product and technical support information is available on this web site (www.okidata.com). You may also contact Oki Data Customer Support by sending e-mail to support@okidata.com.

To get order status, the order airbill or tracking number, or shipment date, enter your order number in the "Check Order Status" field on the Oki Data home page (www.okidata.com) or in the OKI Store. Tracking numbers are available for 30 days after the date orders are placed. Order history information for previous orders is available only to users that have registered in the OKI Store.

Returns
Products purchased in Canada from www.okidata.com or esales.okidata.com may be returned (UNOPENED and in original packaging) within 30 days from the date of purchase (shipment). No returns will be accepted after 30 days. Canadian product returns from (www.okidata.com) are processed by Oki Data's customer support department by contacting 1-800-OKIDATA (654-3282). To return a product, please contact 1-800-OKIDATA and specify that you are making a return, and provide your reason for return and your email address. After supplying this information, an RA (Returns Authorization) number will be sent to you via email from Oki Data's Customer Support department. While you may call to request an RA number 24 hours a day, 7 days a week, an RA number will only be assigned and sent via email during normal business hours (8:00 a.m. to 5:00 p.m. EST/EDT).

After receiving an RA number, you must, at your expense, deliver or ship the product to Oki Data Canada in its original condition and original packaging. All items included with the original package must be returned (software, cables, manuals, etc.). All returns must be accompanied by the properly authorized RA code and other documentation as follows.

A Ship-To label must be addressed in the following manner:

If you are returning an LED printer (i.e., OKIPAGE/B-series model), you must remove and discard the image drum and/or toner, if the toner has been installed.

IMPORTANT NOTE: Shipping a product without adhering to these conditions may result in delay or refusal of credit of your return. Credit will be issued to the original credit card used to place the order only when the returned item is received, accompanied by proper documentation and/or RA#, and your credit card number has been verified and authorized. For your records, Oki Data recommends you keep any shipping documentation for tracking purposes. (Order History is available to registered users after logging in to the OKI Store. Please note that Order History information does not reflect any returns or exchanges.)

Warranty

    (a) Merchandise Warranty: Merchandise purchased from Oki Data's website (www.okidata.com) is covered by the standard product warranty. For further information on warranty or service enhancement programs, please see our Service Enhancement Programs OKICareTM or contact our customer service department at 1-800-OKIDATA (654-3282). Only products purchased from this website may be returned within 30 days. Please refer to the Returns section above.

    (b) Remedies and Limitations: [If, during the Warranty Period, you notify Oki Data that the Merchandise provided by Oki Data is not in good working order or materially fails to conform to the published specifications furnished with the Merchandise on the delivery date, Oki Data shall, at its expense, repair or replace the Merchandise. Notice of any warranty claim by you shall be given to Oki Data promptly by contacting Oki Data's customer support department at 1-800-OKIDATA (1-800-654-3282).] Oki Data shall not be obligated to provide, nor be liable for, any other or additional remedy and Oki Data's sole obligation shall be limited to its warranty obligations as stated above. Oki Data's liability for any breach by Oki Data of its obligation to repair or replace pursuant to this Paragraph (b) shall be limited to direct damages you actually incur and shall not exceed the Agreement price for the Merchandise.

    (c) THE WARRANTY OF OKI DATA SET FORTH IN PARAGRAPH (a) IS EXCLUSIVE AND IS GIVEN BY OKIDATA AND ACCEPTED BY YOU IN LIEU OF ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE (WHETHER KNOWN TO OKIDATA OR NOT). ALL SUCH OTHER WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED BY OKIDATA AND WAIVED BY YOU.

Disclaimer of Consequential Damages: Notwithstanding anything to the contrary herein, Oki Data disclaims and shall not be liable for any special, incidental, indirect, or consequential damages (or equivalents thereof no matter how claimed, computed or characterized), arising out of or in connection with the purchase or use of the Merchandise, regardless of whether any such liability shall be based upon breach of contract, tort (including negligence, gross negligence and strict liability), violation of law or otherwise and whether the claim is brought at law or in equity.

Force Majeure: Any loss, damage, or delay in, or failure of, performance by Oki Data shall not constitute a default under the Agreement or give rise to any claim for damage if such loss, damage, delay, or failure is attributable in whole or in part to any cause or causes beyond the reasonable control of Oki Data.

Risk of Loss: Oki Data shall bear risk of loss until the Merchandise shall come to rest aboard the carrier at Oki Data's loading dock. Thereafter, you shall bear risk of loss; however, Oki Data has secured insurance up to $100 (CDN) on your behalf as part of the freight charges.

Governing Law: The Agreement, its administration and performance, and all the rights, obligations, liabilities, and responsibilities of the parties, thereto, shall be governed by and interpreted in accordance with the laws of the State of New Jersey, without regard to New Jersey conflict of laws principles.

Language: The parties have requested that this agreement be drawn up in English. Les parties ont demande que le present contrat soit redige on Anglais.
